Eligibility: The Believe in What You’re Building Photo Trip Giveaway (the “Sweepstakes”) is only open to those who enter at https://www.petapixel.com/buildyour.photography. The Sweepstakes is open to legal residents of the 50 United States or District of Columbia who are 18 years of age (or the age of majority in their jurisdiction of residence, whichever is older) or older as of date of entry. Employees, independent contractors, interns, officers, directors, members, managers, and agents (collectively, “Affiliates”) of PetaPixel, Identity Digital, CP Collective (collectively, the “Sponsor”) and DUMBO Media Group, Inc. (the “Administrator”) their respective parent companies, affiliates, subsidiaries, professional advisors, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes and are not eligible to win any prize. IF YOU DO NOT MEET ANY OF THESE REQUIREMENTS, OR ANY OTHER ELIGIBILITY REQUIREMENTS IN THESE OFFICIAL RULES, YOU ARE NOT ELIGIBLE TO WIN A PRIZE. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
Agreement to Official Rules: By entering the Sweepstakes, the contestant (“You”) agree to comply with and abide by these Official Rules and the decisions of the Sponsor and Administrator, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Sponsor and Administrator’s decisions as final and binding as it relates to the content of this Sweepstakes. Entrants should look solely to the Administrator with any questions, comments or issues related to the Sweepstakes.
Entry Period: The Sweepstakes begins on October 1, 2022 at 12:00AM PST and ends at on November 18, 2022 at 11:59PM PST (the “Entry Period”). All entries must be received during the Entry Period and meet other requirements in these Official Rules to be eligible to win a prize. Entries submitted before or after the Entry Period will not be eligible. Sponsor’s or its designee’s computer is the official time-keeping device for the Sweepstakes.
How to Enter: To enter, complete the steps for one of the following methods of entry during the Entry Period:
Limit: ONE ENTRY PER PERSON PER DAY FOR UP TO TEN ENTRIES TOTAL THAT INCLUDE A NON-.PHOTOGRAPY DOMAIN DURING THE SWEEPSTAKES PERIOD OR ONE ENTRY PER PERSION THAT INCLUDES A .PHOTOGRAPHY DOMAIN DURING THE SWEEPSTAKES PERIOD. Any attempts to obtain additional entries, including through multiple or duplicate accounts will result in disqualification.
If participating in this Sweepstakes via your mobile device (which service may only be available via select devices and participating wireless carriers and is not required to enter), you may be charged for standard data use from your mobile device according to the terms in your wireless service provider’s data plan. Normal airtime and carrier charges and other charges may apply to data use and will be billed on your wireless device bill or deducted from your pre-paid balance. Wireless carrier rates vary, so you should contact your wireless carrier for information on your specific data plan.
Grand Prize: One (1) Grand Prize winner will receive the following prize:
Total ARV of prize: $4,750.
Grand Prize winner must select and inform the Sponsor and Administrator via email, their destination choice by December 1, 2022. If no choice is communicated by such date, the Sponsor reserves the right to choose the photo trip destination.
Photo Trip must take place between April 1 and June 30, 2023 and Sponsor and Administrator will establish two travel period options (based on the destination selected) and notify the Grand Prize winner of such periods by January 1, 2023. The Grand Prize winner may choose one of these two travel time periods and has until January 30, 2023 to inform the Sponsor via email of the travel period they selected. If no choice is communicated by such date, the Sponsor reserves the right to choose the travel time period.
Grand Prize winner must arrange for their own airfare to their photo trip destination choice as well as any other transportation, spending money, and the cost of food. The 4-night hotel accommodations will be arranged and paid for by the Sponsor and Administrator. A 4-5 star hotel selection will be made at the Sponsor and Administrator’s discretion. Note: Grand Prize winner must provide their own camera, lenses and other photography gear and related supplies during the photo trip.
Prize Restrictions: Actual/appraised value of the prize may differ at time of prize award or received. The specifics of the prize shall be solely determined by the Sponsor and Administrator. No cash substitution or other substitution or exchange of the prize will be made, except that Sponsor reserves the right to substitute the prize of comparable or greater value for any prize. The prize is nontransferable. ANY AND ALL PRIZE RELATED EXPENSES, INCLUDING WITHOUT LIMITATION ANY AND ALL FEDERAL, STATE, AND/OR LOCAL TAXES ASSOCIATED WITH THE USE OR RECEIPT OF THE PRIZE, SHALL BE THE SOLE RESPONSIBILITY OF THE WINNER. Sponsor will not replace any lost or stolen prizes, reimburse or provide a substitute prize to the Grand Prize winner if they are not able to participate in the photo trip for any reason. Acceptance of the prize constitutes permission for the Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Except for applicable manufacturer’s standard warranties, the Grand Prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including any implied warranty of merchantability or fitness for a particular purpose).
Odds of Winning: The odds of winning depend on the number of eligible entries received.
Winner Selection and Notification: On or about November 19, 2022, the name of one potential winner of the prize will be selected in a random drawing from among all eligible entries under the supervision of the Administrator. Any potential winner will be notified via a single e-mail to the e-mail address they used to enter the Sweepstakes within two (2) days following the winner selection.
To the fullest extent permitted by applicable law, Sponsor may require each potential winner to sign, notarize, and return, within seven (7) days of being notified they have been selected as a potential winner, an Affidavit of Eligibility and Liability/Publicity Release (the “Affidavit”) in order to claim their prize.
The Sponsor and Administrator shall have no liability for a Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the selected Winner (i) cannot be reached at the email address used to enter the Sweepstakes, (ii) is ineligible, (iii) fails to claim the prize within seven (7) days from the time award notification was emailed, (iv) fails to return any required documents are not returned within seven (7) days, such as the Affidavit of Eligibility and Liability/Publicity Release; or (v) if potential winner is otherwise unable to accept the prize as stated, the prize will be forfeited and may be awarded to an alternate winner, the prize may be forfeited and an alternate winner selected. Receipt of the prize offered in this Sweepstakes by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at the Administrator’s sole discretion will result in the Winner’s disqualification as winner, and all privileges as winner will be immediately terminated.
If the first potential winner is unable or ineligible to claim the prize, Administrator will hold alternate drawings until the prize has been awarded. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, an alternate winner will be selected in accordance with the above selection process from among all eligible claimants making purportedly valid claims to award the prizes available.
Verification of Potential Winner: EACH POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY THE ADMINISTRTOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A PRIZE WINNER UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE AND NO FURTHER ACTION IS NEEDED.
Rights Granted by the Entrant: By entering the Sweepstakes, You understand and agree that the Sponsor and Administrator and anyone acting on behalf of the Sponsor and Administrator or their respective licensees, successors, and assigns, shall have the right to use winner’s name, picture/portrait likeness and/or voice, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, grant of additional rights, or consent, unless prohibited by law.
Terms and Conditions: The Sponsor and Administrator reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, non-authorised human intervention, fraud, natural disasters, health crises such as epidemics and pandemics, riots, war, terroristic activity, civil disorder, court orders, acts or regulations of governmental bodies, labor disputes or failures in electrical power, heat, light, air conditioning or telecommunications equipment or lines, or other causes beyond Sponsor’s or Administrator’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such cases, the Administrator may select a winner(s) from eligible entries received before and/or after remedial action taken by the Sponsor and Administrator, if appropriate. The Sponsor and Administrator reserve the right at their sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules. Limitation of Liability: By entering the Sweepstakes you agree to release and hold harmless PetaPixel, Identity Digital Inc., CP Collective, and DUMBO Media Group Inc. and each of their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (the “Released Parties”) from any liability, illness, injury, death, loss, litigation, claim or damage (including claims, costs, injuries, losses and damages related to rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), that may occur, directly or indirectly, whether caused by negligence or not, whether under a theory of contract, warranty or other theory, from (i) your participation in the Sweepstakes and/or your acceptance, possession, use, misuse of or inability to use any prize or any portion thereof; (ii) unauthorised human intervention in any part of the Sweepstakes; (iii) electronic or human error in the administration of the Sweepstakes or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT WILL THE SPONSOR OR THE ADMINISTRATOR BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED TO YOUR PARTICIPATION IN THE SWEEPSTAKES OR USE OR INABILITY TO PARTICIPATE IN THE SWEEPSTAKES OR ANY PRIZE, EVEN IF A RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES (JOINTLY) ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE SWEEPSTAKES OR USE OF OR INABILITY TO PARTICIPATE IN THE SWEEPSTAKES OR PRIZE PROVIDED FOR USE IN THE SWEEPSTAKES OR ANY PRIZE EXCEED THE AVR OF THE PRIZE AT THE TIME THE ENTRY PERIOD HAS ENDED. THE LIMITATIONS SET FORTH IN THIS LIMITATIN OF LIABILITY SECTION WILL NOT EXCLUDE OR LIMIT LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY PRODUCTS RENTED FROM THE SPONSOR, OR FOR THE RELEASED PARTIES’ GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR FOR FRAUD.
Disputes: This Sweepstakes is governed by the laws of the State of Washington, without respect to conflict of law or choice of law doctrines. By participating in this Sweepstakes, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a united states district court for the Western District of Washington or the appropriate state court located in King County, Washington. YOU WAIVE ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS.
